LOTZ & LOTZ v FB van der Vyver

We have been requested by our client, Mr Fred van der Vyver, to issue the following statement:

For the past few months, a campaign has been waged in the press against our client Mr. Fred van der Vyver in which it has been stated and reported widely that Porfessor and Mrs. Lotz, the parents of Inge Lotz, have found “new evidence” against Mr van der Vyver. Most of these statements have been made by a Ms Dani Cohen as spokesperson for Prof & Mrs Lotz.

Among the statements so made is the allegation that “new, crucial evidence” has been found against Mr van der Vyver to “establish he murdered Inge”.

As a consequence of these press statements Counsel for Mr van der Vyver requested further particulars for trial to the claim instituted against him by Prof. and Mrs. Lotz, referring specifically to Ms Cohen’s statements and requesting the plaintiffs to set out fully what new material fact or facts plaintiffs will rely upon in their action.

In response to such request, the legal representatives of Prof. and Mrs. Lotz’s have replied as follows:

“There are no new material facts upon which the plaintiffs intend to rely.”

Both the request for particulars and the reply thereto are filed at Court.

A letter reserving Mr van der Vyver’s rights against Prof and Mrs Lotz, and Ms Cohen, in regard to the above defamatory statements and the damage that Mr van der Vyver is suffering, will soon be served on the attorneys of Prof and Mrs Lotz.

      My oh my!! Hoekom is ek dan nou geensins verbaas nie? Ek wonder hoekom die regsverteenwoordigers vir die Lotze nie hierdie verklaring reggestel het nie? Daar was tog genoeg tyd om dit te doen tot nou toe indien dit dan bekend was dat dit nie korrek is nie? Sou mens hierdie traagheid toeskryf aan kwaadaardigheid? Ek wonder maar net.

      Jammer, vervang “kwaadaardigheid” met “kwaadwillgheid”. Ek dink eersgenoemde is meer gepas by siektes.

      No, Truthseeker. There are no positive numbers on the scoreboard, only negative ones. That is because there are no winners, only losers. Inge lost her life. Fred lost his future. The Lotzes lost their only child and the joy of ever holding grandchildren. The honest police in SAPS lost a measure of their reputation. The people of South Africa lost faith in their police, their government, and a degree of their hope for the future.

      In my job over the years, I have seen people get so angry, so despondent, so irrational in their loss, that they turn against those who they love and those who are trying to help. I believe the Lotzes are in that state of mental anguish, consumed with hatred for which, after Inge’s murder, they had no target. Their neighbor and “good friend,” Trollop, gave them that target — Fred van der Vyver. Once they had focused on Fred, in spite of conclusive evidence he did NOT kill Inge and the police investigators had fabricated the evidence, they had become unable to change their minds. Everyone who says Fred is innocent is part of the conspiracy, while everyone who agrees Fred is guilty becomes their trusted ally and their safety net.

      No, Truthseeker. It’s a sad and sorry situation. There are no winners and there can be no justice from this mess now, only lawsuits to try and reclaim spent money while the lawyers continue to charge, Inge’s real killer goes free, and more victims of injustice pile up. And the longer it drags on, the more the loses will be for Fred and his family, for the Lotzes, for the South African Police Service, and for the people of South Africa.

      No winners. We all lose.

      Ek sukkel deesdae om simpatie te he met die Lotze.

      Dis vreeslik wat hul oorgekom het, maar dit wat hul nou aan Fred doen is om die minste te se onvergeefbaar. Op die ou einde sal hul moet leer om met hul gewete saam te leef…
